1. Scope & Legal Agreement
1.1. These Terms and Conditions ("Agreement") govern the contractual relationship between the Participant ("you") and the Organizer ("we" or "Us").
1.2. By registering, paying for, or attending the Immersion, you agree to be bound by these Terms and Conditions in their entirety.
2. Pricing, Payments & Tiered Pricing
2.1. Pricing Tiers (incl. VAT):
• Early Tier (Spots 1–3): €1,999
• Standard Tier (Spots 4–6): €2,333
• Final Tier (Spots 7–9): €2,666
2.2. Payment Terms: Full payment is due immediately upon registration. If an individual payment plan is granted in writing by the Organizer, all scheduled payments must be completed in full prior to October 13, 2026. Failure to complete payments on schedule may result in immediate cancellation of your spot without a refund.
3. Statutory Exclusion of Right of Withdrawal & No Refund Policy
3.1. Exclusion of Statutory Withdrawal Right: Pursuant to Section 312g paragraph 2 no. 9 of the German Civil Code (BGB), the statutory 14-day right of withdrawal for consumer distance contracts does not apply to contracts for the provision of services related to leisure activities bound to a specific date or period. All bookings are final and legally binding upon payment.
3.2. No Refunds: Payments are strictly non-refundable under any circumstances, including participant illness, travel delays, visa denials, or personal scheduling conflicts.
3.3. Ticket Transfer: You may transfer your registration to another individual provided that:
• You notify the Organizer in writing no later than October 3, 2026 (23:59 CET).
• The recipient completes and signs this Agreement prior to October 6, 2026.
• The Organizer approves the replacement participant in writing. Any financial settlement for transferred tickets must be handled directly between you and the recipient.
4. Inclusions, Travel & Accommodation Disclaimers
4.1. Inclusions: Registration fees cover specified immersion activities, group facilitation, and scheduled meals provided on-site during event hours.
4.2. Travel Responsibilities: You are solely responsible for arranging and paying for all travel to, from, and around Bamboo Park, Germany. The Organizer assumes no liability for travel disruptions, flight delays, missed transit, or daily commuting costs between off-site lodging and the venue.
4.3. Accommodation: Accommodation is not included in the immersion fee. Staying in a shared yurt (€214 incl. VAT) is a separate arrangement booked directly through Bamboo Park. The Organizer is not a party to your accommodation agreement with Bamboo Park and accepts no liability regarding venue facilities, lodging quality, or venue-related incidents.
5. Event Cancellation or Modification by the Organizer
5.1. The Organizer reserves the right to cancel or reschedule the Immersion due to events of force majeure (e.g., natural disasters, severe weather, unexpected venue closures, official travel bans) or severe facilitator illness.
5.2. If the Immersion is canceled by the Organizer, you will receive an event credit equal to 100% of the amount paid. Credits may be redeemed for future immersions or offerings provided by the Organizer or Lead Facilitator within 24 months. Cash refunds will not be issued.
5.3. The Organizer is not responsible for non-refundable travel expenses (such as airline tickets or off-site hotel bookings) incurred by participants.
6. Medical Disclosures, Somatic Practices & Liability
6.1. Nature of Activities: The Immersion includes somatic practices, movement work, personal touch, and potential emotional release work. It does not involve certified clinical breathwork or high-intensity athletic conditioning.
6.2. Not Therapy: Somatic activities provided during the Immersion are intended for personal exploration and wellness. They do not constitute medical, psychiatric, or clinical psychological therapy, diagnosis, or treatment.
6.3. Participant Fitness: You confirm that you are in good physical, mental, and emotional health necessary to safely participate. You agree to inform the Organizer in writing prior to October 13, 2026, of any pre-existing medical conditions, severe psychological conditions, physical injuries, or pregnancy.
6.4. Limitation of Liability (BGB Compliance):
• The Organizer is liable without limitation for damages arising from injury to life, body, or health resulting from an intentional or negligent breach of duty by the Organizer or its legal representatives.
• For all other damages, the Organizer’s liability is limited strictly to cases of intent (Vorsatz) or gross negligence (grobe Fahrlässigkeit). Liability for ordinary/mild negligence is excluded, provided it does not involve the breach of essential contractual duties (Kardinalpflichten).
• The Organizer is not liable for loss, theft, or damage to personal belongings brought to Bamboo Park.
7. Code of Conduct, Substance Prohibition & Ejection
7.1. Substance Policy: The possession or consumption of illegal drugs, recreational substances, or excessive alcohol is strictly prohibited for the duration of the Immersion.
7.2. Respectful Conduct: Participants are expected to maintain an environment of respect, safety, and mutual dignity. Disruptive, discriminatory, threatening, or harassing behavior toward facilitators, staff, or other participants will not be tolerated.
7.3. Termination for Cause (Kündigung aus wichtigem Grund): The Organizer reserves the right to immediately terminate your participation and remove you from the venue without refund if you violate substance rules or engage in disruptive/unsafe conduct.
7.4. Early Departure: Voluntary early departure from the Immersion does not entitle you to any partial refund or future credit.
8. Travel & Health Insurance
8.1. You are strongly advised to purchase comprehensive international travel, health, accident, and trip-cancellation insurance covering the duration of your trip.
9. Media Release & Data Protection
9.1. Photo & Video Consent: Photos and videos will be taken during designated portions of the Immersion and may be used by the Organizer and Lead Facilitator for marketing, website, and social media purposes. By attending, you grant permission for your likeness to be included in such media.
9.2. Opt-Out Right: You retain the right to opt out of media capture by providing written notice to the Organizer prior to October 6, 2026.
9.3. Data Protection (GDPR): Personal data (name, contact info, health disclosures) collected during registration is processed in strict compliance with the EU General Data Protection Regulation (GDPR / DSGVO) solely for event administration, safety, and accounting purposes.
10. Governing Law & Choice of Forum
This Agreement and any disputes arising from or in connection with it shall be governed exclusively by the laws of the Federal Republic of Germany, excluding its conflict of laws rules. The sole place of jurisdiction for any legal disputes shall be the court having jurisdiction over the registered seat of the Organizer.
